Terms of Service

1. Introduction and Scope

These Terms of Service ("Terms") govern your access to and use of the Quizcam mobile application ("App") and the associated website at quizcamapp.com ("Website"), collectively referred to as the "Service." The Service is provided by:

By downloading, installing, or using the App, or by accessing the Website, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

2. Description of Service

Quizcam allows users to create interactive quizzes from their learning materials. The App enables users to capture notes via camera or import PDF documents. The Service uses optical character recognition (OCR) and artificial intelligence to extract text and generate quiz questions from user-provided content.

3. Eligibility

The Service is available to users of all ages. If you are under the age of 16 (or the applicable age of digital consent in your jurisdiction), you must have the consent of a parent or legal guardian to use the Service. By using the Service, you represent that you meet these requirements.

4. Account and Registration

You may use the App without creating an account (anonymous usage). Optionally, you may sign in using Apple Sign-In or Google Sign-In. If you create an account, you are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

5. Free and Premium Plans

5.1 Free Plan

The free plan provides limited access to the Service, currently including one (1) quiz generation per day. We reserve the right to modify the free allowance at any time.

5.2 Premium Subscription

Premium subscriptions unlock unlimited quiz generation and are available as Weekly or Yearly plans. Subscriptions are processed exclusively through Apple In-App Purchase. By subscribing, you also agree to Apple's terms and conditions for In-App Purchases and subscriptions.

5.3 Subscription Renewal and Cancellation

• Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the end of the current period.
• You can manage and cancel your subscription in your Apple ID account settings.
• No refunds will be provided for partial subscription periods, except as required by applicable law or Apple's refund policies.

5.4 Restore Purchases

You may restore previously purchased subscriptions using the "Restore Purchases" feature in the App.

6. User Content

"User Content" refers to any materials you provide to the Service, including photos, PDFs, and other documents.

• You retain all ownership rights to your User Content.
• By uploading User Content, you grant us a limited, non-exclusive license to process your content solely for the purpose of providing the Service (i.e., OCR extraction and quiz generation).
• We do not use your User Content for advertising, marketing, or any purpose unrelated to delivering the Service.
• You represent that you have the necessary rights to upload and process the content you provide.

7. AI-Generated Content

Quizzes generated by the Service are created using artificial intelligence (Google Vertex AI). While we strive for accuracy, AI-generated content may contain errors, inaccuracies, or incomplete information. The Service is intended as a supplementary learning tool and should not be relied upon as the sole source of information for exams or certifications. We make no warranties regarding the accuracy or completeness of AI-generated quiz content.

8. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws.
• Upload content that infringes third-party intellectual property rights.
• Attempt to reverse-engineer, decompile, or otherwise derive the source code of the App.
• Interfere with or disrupt the Service, servers, or networks connected to the Service.
• Use automated means (bots, scrapers) to access the Service.
• Circumvent any usage limits or access controls of the Service.

9. Intellectual Property

The App, Website, and all associated content, features, and functionality (excluding User Content) are owned by Julius Schröder and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without express written permission.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, JULIUS SCHRÖDER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING FROM YOUR USE OF THE SERVICE.

Our total aggregate liability for any claims arising out of or relating to the Service shall not exceed the amount you have paid us in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Julius Schröder from and against any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Service, your User Content, or your violation of these Terms.

13. Modifications to the Service and Terms

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time. We may also update these Terms from time to time. If we make material changes, we will notify you through the App or by other reasonable means. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.

14. Termination

We may terminate or suspend your access to the Service at any time, with or without cause, and with or without notice. You may stop using the Service and delete your account at any time through the Settings screen in the App. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will survive (including Sections 6, 9, 10, 11, and 12).

15. Account Deletion

You may request deletion of your account and associated data through the App's Settings screen. Account deletion is subject to a multi-step confirmation process. Upon deletion, your quiz data and personal information will be permanently removed from our servers, subject to any legal retention requirements.

16. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Hamburg, Germany, unless mandatory consumer protection laws of your jurisdiction provide otherwise.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
